House of Lords Upholds Strike out of Claim Brought by Stone & Rolls

LONDON - The House of Lords has delivered judgment in Moore Stephens’ application to strike out the legal action brought against them by former client Stone & Rolls Limited (in liquidation).
The House of Lords upheld the decision of the Court of Appeal to strike out the claim. It did so on the basis that the loss Stone & Rolls was claiming arose directly from its own fraudulent activities, and that such a claim is barred by the principle of public policy that the court will not assist a claimant to recover compensation for the consequences of his own illegal conduct.
Richard Moore, senior partner of Moore Stephens LLP, commented: “We are naturally pleased with this outcome. We have said from the outset that we considered the claim against us should fail and the House of Lords’ decision has vindicated our position.”
