Sullivan & Cromwell’s John Hardiman and David Rhodes Contribute Chapter to International Commercial Litigation Guide

NEW YORK - Sullivan & Cromwell LLP is pleased to announce that London-based partner John Hardiman and associate David Rhodes, assisted by associates Andreas Stier and Tia Vasquez, have co-authored a chapter on United States law in the recently released International Commercial Dispute Resolution, edited by Jonathan Warne and published by Tottel Publishing. The chapter focused on United States law is one of 24 chapters, each addressing a different geographic jurisdiction and focusing on the needs of international litigators in understanding these markets.
The book is a definitive international guide incorporating expert advice from leading law practitioners in each jurisdiction; each region is an established or developing financial center. The goal of the book is to provide efficient and effective guidance to practitioners to resolve commercial disputes. Each chapter seeks to address the key issues facing litigators in commercial litigation, with particular attention paid to both traditional court and arbitration proceedings.
The chapter authored by Messrs. Hardiman and Rhodes addresses, among other things:
- The major aspects of U.S. litigation, in both federal and state courts, aimed at helping international practitioners understand the implications of litigating in the U.S.; - How U.S. courts approach many international aspects of litigation, including service of process and personal jurisdiction over foreign defendants, subject matter jurisdiction over claims having foreign elements, discovery from foreign persons and entities, and recognition of foreign judgments and arbitral awards; and - U.S. approaches to alternative dispute resolution (”ADR”), including ADR pursuant to contract and pursuant to court-sponsored programs.
(Notably, James Carter, S&C partner and experienced International Arbitration practitioner, had contributed the chapter on this topic in the first edition of the book, published in 1997.)
