Action to Strike out Everseal Mailers Patent

LONDON, February 23, 2010 - Yesterday, 22 February, Mastermailer Stationery Ltd issued proceedings in
the Patents County Court to have UK patent GB2340073 in the name of Jonathan
Horler revoked. Mr Horler has granted an exclusive licence to Everseal
Mailers Ltd to market products under this patent in the UK.
In a legally non-binding opinion dated 19 February 2010 the UK
Intellectual Property Office (UKIPO) has indicated that claims 1 to 5 of the
Horler Patent would be infringed by samples of Mastermailer products provided
to UKIPO by Everseal Mailers. Having conducted tests on the pressure required
to seal the current Mastermailer products, Mastermailer is entirely satisfied
that its production does not infringe the Horler Patent. Any legal challenges
which Mr Horler and/or Everseal Mailers choose to initiate will be defended
vigorously and in any case would, of course, be overridden by a successful
challenge to revoke the Horler patent in the proceedings now issued by
Mastermailer.
Commenting on these developments, Mr Patrick Rogers, Mastemailer's
commercial director, said ' We note that Mr Horler and Everseal have chosen
to spend GBP 200 with the UKIPO to obtain a legally non-binding opinion. For
our part we prefer given the strength of our case and our ability to finance
it, to cut to the chase and to apply direct to the Patents County Court to
have their patent revoked.'
Everseal Mailers Ltd, along with Evrite Ltd and Evrite Software Ltd, is
part of the Evrite Group of companies, owned and controlled by Mr Stephen
Black's family. Evrite Ltd is subject to a winding-up petition to be heard in
the Royal Courts of Justice on 17 March 2010.
